If a product is listed at an incorrect price due to a typographical, technical, supplier, or other error, we reserve the right to correct the error and, where permitted by law, cancel or decline an affected order.

If you have already paid for an order that we cannot fulfill because of a pricing error, we will provide an appropriate refund of the affected amount.

Prices, promotions, and product availability may change without notice unless you have already entered into a binding purchase agreement specifying otherwise.

5. Orders and Acceptance

Submitting an online order does not necessarily mean that Backyard Living Center has accepted the order.

Certain products, including hot tubs, spas, customized products, specially ordered products, or products ordered specifically for a customer, may require a deposit.

Deposits and special orders may be subject to additional cancellation, refund, or restocking terms communicated to you before or at the time of purchase.

Because some products may be ordered, configured, manufactured, or reserved specifically for you, cancellation rights may differ from those applicable to regularly stocked products.

Please confirm applicable cancellation and deposit terms before placing a special order.

8. Financing

Backyard Living Center may make third-party financing options available to customers.

Financing is provided by independent third-party financial providers or advisers and is subject to their approval criteria, interest rates, fees, terms, privacy policies, and agreements.

Backyard Living Center does not guarantee financing approval.

Unless expressly stated otherwise, the financing provider—not Backyard Living Center—is responsible for decisions regarding financing applications, credit approval, interest rates, loan terms, and related financial services.

You should carefully review all financing terms before entering into a financing agreement.

9. Delivery

Delivery availability, timing, pricing, and requirements depend on the product, delivery location, site conditions, and services purchased.

Any delivery date or time provided by Backyard Living Center is an estimate unless expressly guaranteed in writing.

Delivery may be affected by circumstances outside our reasonable control, including:

• Manufacturer or supplier delays
• Transportation delays
• Weather
• Road conditions
• Product availability
• Labour availability
• Site accessibility
• Events beyond our reasonable control

Customers are responsible for providing accurate delivery information and informing us in advance about conditions that could affect delivery.

Additional charges may apply where delivery requires services or equipment beyond those originally anticipated.

10. Hot Tub and Spa Delivery Requirements

Hot tubs, spas, and other large products may require specialized delivery arrangements.

Before delivery, you are responsible for ensuring that the delivery location is reasonably accessible and properly prepared.

Depending on the installation, this may include ensuring:

• Adequate access to the installation location
• Gates, pathways, clearances, and overhead areas are sufficient
• The installation surface or foundation is appropriate
• Required electrical service is available
• Required plumbing or drainage considerations have been addressed
• Obstacles have been removed
• Any necessary permits or approvals have been obtained

Cranes, specialized lifting equipment, unusual access requirements, structural modifications, electrical work, landscaping work, or other additional services are not included unless specifically stated.

Additional charges may apply if delivery cannot reasonably be completed because the site was not properly prepared or information about access conditions was inaccurate or incomplete.

11. Installation and Site Preparation

Proper site preparation is important for the safe installation and operation of hot tubs, spas, and related equipment.

Unless specifically included in your purchase agreement, the customer is responsible for site preparation and for obtaining any required professional services.

This may include:

• Concrete pads or other suitable foundations
• Deck or structural preparation
• Electrical service
• Plumbing
• Drainage
• Permits
• Municipal approvals
• Building or electrical inspections
• Safe access to the installation location

Electrical work must be performed in accordance with applicable laws, electrical codes, manufacturer requirements, and inspection requirements.

Customers should use appropriately qualified and licensed professionals where required.

Backyard Living Center is not responsible for defects or damage caused by an unsuitable installation location, inadequate structural support, improper electrical work, improper site preparation, or work performed by third parties outside our control.

12. Customer Responsibilities

You are responsible for reading and following all applicable manufacturer instructions, safety information, operating manuals, maintenance requirements, and warranty conditions.

Hot tubs, spas, pools, chemicals, and related products must be used and maintained appropriately.

Depending on the product, this may include responsibility for:

• Maintaining proper water chemistry
• Maintaining appropriate water levels
• Cleaning and replacing filters
• Protecting equipment from freezing
• Following winterization requirements where applicable
• Using appropriate chemicals
• Maintaining covers and accessories
• Following electrical and safety requirements
• Supervising children and other users
• Following manufacturer maintenance schedules

Failure to properly install, operate, or maintain a product may cause damage and may affect warranty coverage.

13. Water Care and Chemicals

Customers are responsible for following product labels, manufacturer instructions, safety directions, and recommended procedures when using hot tub, spa, pool, or water-care chemicals.

Chemicals should be stored and handled safely and kept away from children and pets.

Do not mix chemicals unless expressly directed by the applicable manufacturer.

Backyard Living Center is not responsible for damage resulting from improper chemical use, incorrect water chemistry, failure to maintain water chemistry, or failure to follow manufacturer instructions.

14. Returns, Exchanges, and Cancellations

Returns, exchanges, and cancellations are subject to the policies and terms applicable to the particular product or transaction.

Eligibility may depend on factors including:

• Product type
• Product condition
• Whether the product has been used or installed
• Whether the product was specially ordered
• Manufacturer requirements
• Time elapsed since purchase
• Health or safety considerations
• Whether consumable products have been opened

Certain products may be final sale or subject to restocking charges where disclosed at or before purchase.

Nothing in these Terms limits any return, refund, cancellation, or other rights that cannot lawfully be excluded under applicable consumer protection laws.

15. Manufacturer Warranties

Many products sold by Backyard Living Center may be covered by warranties provided by their manufacturers.

Manufacturer warranties are subject to the manufacturer’s applicable warranty terms.

Where appropriate, Backyard Living Center may assist customers with warranty inquiries or claims, but the existence and scope of a manufacturer’s warranty are determined by the applicable manufacturer’s terms.

16. Service and Repairs

Service, maintenance, diagnostics, and repair work may be subject to separate fees, estimates, work orders, or service terms.

A diagnostic or service charge may apply even where a repair is ultimately covered in whole or in part by a manufacturer warranty, depending on the applicable warranty and circumstances.

Additional charges may apply for travel, labour, parts, difficult access, repeat visits, or services outside applicable warranty coverage where disclosed or agreed upon.

We will make reasonable efforts to explain applicable service charges before performing chargeable work.

17. Promotions and Discounts

Promotions, discounts, contests, coupons, rebates, and special offers may be subject to additional terms.

Unless otherwise stated:

• Promotions cannot necessarily be combined
• Promotions are available only during the stated promotional period
• Product availability may be limited
• Some products or brands may be excluded
• Discounts have no cash value
• Promotions may be changed or withdrawn where permitted by law

Manufacturer rebates or promotions may also be subject to separate manufacturer terms.

28. Force Majeure

To the extent permitted by law, Backyard Living Center will not be responsible for delays or failure to perform obligations caused by circumstances reasonably beyond our control.

Such circumstances may include severe weather, natural disasters, fires, floods, transportation interruptions, supply-chain disruptions, manufacturer delays, labour disruptions, government actions, public emergencies, utility failures, or other events beyond our reasonable control.

We will make reasonable efforts to address affected orders or services when circumstances permit.

29. Governing Law

These Terms are governed by the laws of the Province of Saskatchewan and the applicable federal laws of Canada.

Subject to any rights or procedures that cannot legally be waived, disputes relating to these Terms, the Website, or transactions governed by these Terms will be subject to the jurisdiction of the courts of Saskatchewan.

30. Consumer Rights

These Terms are not intended to restrict any rights or remedies available to consumers under applicable Saskatchewan or Canadian law that cannot legally be waived, limited, or excluded.

If any provision of these Terms conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will apply.

31. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible, and the remaining provisions will continue in effect.

32. No Waiver

If Backyard Living Center does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.
